Terms of Service

OrbitOFWarrior | Cosmic Empire (the Windows desktop client and the Android app) and its official website are provided by Çetin Tepe (Nilüfer / Bursa, Türkiye; "we"). These terms are the agreement between you and us.

By creating an account, playing the game or using the website, you accept these terms, the Privacy Policy and the Refund and Withdrawal Policy. If you do not accept them, do not use the game.

• You must be at least 13 (16 in the EU) to create an account. If you are under 18, you need a parent's or guardian's permission to play and to make purchases.
• Provide accurate information when registering.
• You are responsible for keeping your account and password secure. Actions taken from your account are treated as yours.
• Accounts are personal: they may not be sold, rented, transferred or shared.
• Pilot names, clan names and profile pictures must not contain insults, hate speech, obscenity or impersonation. We may change names or remove pictures that break these rules.
• If you notice suspicious access, write to us right away. Our support team will never ask for your password.

• Credits, Orbitium (ORB), Nova and other in-game currencies, premium and all in-game items are a limited, non-transferable licence to use them in the game. They are not your property, have no real-world value and cannot be exchanged for money.
• Buying or selling accounts, items or currencies for real money outside the game is prohibited.
• You accept that items, prices, stats and drop rates may be changed to keep the game balanced.
• If an item with random rewards is sold, the reward odds are shown in the game before purchase.

• Android app: purchases are made through Google Play and are subject to Google Play's terms.
• Desktop client and website: purchases are made through our payment provider Xsolla, which acts as the merchant of record for these sales; payment and invoicing are subject to Xsolla's terms. Your card details never reach us.
• Prices are shown on the purchase screen.
• Digital content is delivered to your account immediately once payment is confirmed.
• Premium lasts for the period purchased and does not renew automatically.
• We may change prices and bundle contents; changes do not affect completed purchases.

See the Refund and Withdrawal Policy for details. In short:

• For digital content delivered immediately, the statutory right of withdrawal does not apply once you have agreed to this at purchase.
• We fix or refund purchases that were not delivered, were charged twice, or cannot be used because of a technical error.
• If a purchase is refunded or charged back, the content granted for it is removed from your account.
• Your statutory consumer rights are not affected.

The following lead to sanctions:

• Cheats and bots: automation software, macros, modifying the client, interfering with network traffic, reverse engineering, exploiting bugs. You must report any bug you find.
• Multi-account abuse: using several accounts to feed each other for an unfair advantage.
• Harassment and hate speech: insults, threats, racism, sexism, persistent harassment, spam.
• Fraud: real-money trading, fake payments, chargeback abuse, phishing.
• Attacks on the service: overloading servers, bypassing security, unauthorised access to another account.
• Sharing personal information: sharing someone else's personal information without permission.
• Impersonation: pretending to be staff or a member of the game team.

• You are responsible for what you put into the game: chat messages, pilot and clan names, profile text and pictures.
• You allow us to use, display and store this content to provide and promote the service.
• Chat and profile pictures are moderated automatically (see the Privacy Policy). Content that breaks the rules may be removed, hidden or changed.

All elements of the game belong to us and are protected by copyright, including its name, logo, emblems, ship and map art, interface, music, sounds, texts and source code.

We grant you a limited, non-transferable, revocable licence to play the game for personal, non-commercial use. You may share screenshots, make videos and stream the game, including monetising them on video and streaming platforms.

Any other copying, modification, distribution or commercial derivative work requires our written permission.

Depending on severity, we apply graduated sanctions: a warning, a chat mute, sending you to the jail zone, a temporary suspension, a permanent ban. We may remove items and balances gained unfairly. Serious violations (cheating, fraud, attacks) may lead directly to a permanent ban.

Items and balances on accounts closed for rule violations are not refunded, without prejudice to your statutory rights.

To appeal, write to [email protected]; a person will review the case.

You can delete your account at any time: in the game under Settings → Account → Delete account, or on the Account Deletion page of our website. After a 7-day waiting period the account is deleted; signing in during this period cancels the request. Items and balances on a deleted account cannot be restored or refunded.

We aim to run the game without interruption, but maintenance, updates, infrastructure failures or causes outside our control may cause downtime. Planned maintenance is announced in the game in advance.

We may develop, rebalance, change or remove game content.

If we have to shut the service down entirely, we will announce it in the game at least 30 days in advance.

The game is provided "as is". We do not guarantee that it will run without interruption or errors.

To the extent permitted by law, we are not liable for indirect damages, data loss, loss of profit, or loss of in-game progress or items. Where we are liable, our total liability is limited to the amount you paid us in the last 12 months.

This does not limit liability for intent or gross negligence, or your statutory consumer rights.

We may update these terms. We announce significant changes in the game and on this page before they take effect. Continuing to play after a change means you accept the new terms.

These terms are governed by the laws of the Republic of Türkiye.

• If you are a consumer: you may apply to the consumer arbitration committee or consumer court of your place of residence within the statutory limits. Mandatory consumer protections of your country of residence are not affected.
• Other disputes: the courts and enforcement offices of Bursa have jurisdiction.

The Turkish and English versions are equivalent. In case of conflict, the Turkish version prevails.
